BHHS Preferred Auburn is excited to sponsor a hole-in-one contest for the designated golf events.
In general, here are the rules and regulations that you need to know in order to participate:
1) The contests are open to qualified participants in each respective tournament (The Celebrity Golf Classic at Saugahatchee Country Club on October 2, 2015 and the Auburn Chamber Golf Classic at The Auburn University Club on October 8, 2015).
2) Only amateur golfers properly registered for the respective event will be allowed to participate. Professionals, semi-professionals, club pros or any other non-amateur level golfer is not allowed to participate.
3) Every qualified participant will compete on a designated hole for "closest to the pin." The five golfers in each event that are "closest to the pin" on the qualifying hole will shoot for $400,000 to put towards a new or existing home.
4) The $400,000 prize must be applied to a new home listed or offered for sale by Berkshire Hathaway HomeServices Preferred Real Estate.
5) In the case of the Auburn Chamber Golf Classic on October 8, 2015, the $400,000 prize must be applied to a new home listed or offered for sale by Berkshire Hathaway HomeServices Preferred Real Estate in one of the following communities: Falls Crest at Auburn University Club, PARC at University Club or Club Creek. No exceptions.

Below are specific rules and regulations set forth by the insurer of this contest. Please read carefully.
NATIONAL HOLE-IN-ONE (NHIO) hereby agrees to provide the prize award or its agreed value as stated in this Contract to the Ace-Maker® that
makes a Hole-In-One according to the USGA Rules of Golf on the date(s) and target hole(s) as specified in the Contract. This payment obligation is
conditioned upon full compliance with each of the following Contract Conditions whether or not any tournament rules are in conflict with these
Contract Conditions and whether or not NHIO is prejudiced by any such non-compliance.
CONTRACT CONDITIONS - SHOOTOUT CONTRACT
(Read Carefully)
A. BEFORE EVENT
1. PAYMENT - A timely paid Contract fee is the basis for issuing a Contract Payment is not timely unless an envelope addressed to
NHIO containing a valid and collectable check for the NHIO event fee and must be postmarked by the U.S. Postal Service prior to the
day of the event, or payment by a credit card has been arranged with NHIO prior to the event. Certified mailing or postal receipt is
strongly recommended. On all matters pertaining to payment of an event fee any insurance agent or other third party acts
exclusively on behalf of the applicant and not on behalf of NHIO.
2. CONFIRMATION OF TERMS - When feasible NHIO will FAX, EMAIL, or send by first class mail written confirmation of all
critical terms including the event fee prior to the event. Any changes to event data must comply with Variable Event
Conditions D.1. below.
3. PUBLICITY - The names, likenesses, photos and videotape furnished by the Sponsor may be used for marketing
purposes by NHIO without any additional compensation.
B. DURING EVENT
1. WITNESSES - All witnesses for shootout events must be event non-participants, age 18 or over, of good moral character, and
appointed by the Client or Prize Sponsor as follows: Prize limits up to $100,000 two witnesses; $100,001 to $250,000 two
witnesses (one of which is a PGA Certified Golf Professional); $250,001 and above require a PGA Certified Golf Professional
witness and continuous unedited videotape of all eligible shots by a second witness. Continuous unedited videotape must be
recorded from behind the green and include in the frame the participants’ shots, the target hole and the ball going into the hole.
WARNING – It is the Client’s duty to ensure witnesses are positioned safely.
2. YARDAGE - The target hole(s) yardage shall be no less than that specified in this Contract when measured from the teeing ground
to the flagstick, provided however, in a shootout event where men are the majority of event participants. Amateur women only are
permitted to use the teeing ground no more than 15 yards less than the yardage specified for men, but in no event less than 135
yards. Only amateur women are eligible for the 15 yard reduction. All women professionals must tee off from the stated
Contract distance.
3. CONTESTANT CATEGORY - A contestant is an Amateur if they meet the USGA Rules of Amateur Status on the date of the event.
Contestants that do not qualify as an Amateur pursuant to USGA Rules are Club Professionals unless they currently hold or have
ever held a card issued by the PGA Tour or similar international governing body making them eligible to play on any professional tour
worldwide, in which event they are a Tour Professional. Tour Professionals are to be forever designated a Tour Professional
regardless if they are active or not.
4. ELIGIBLE CONTESTANTS - All officially registered and qualified contestants for the event in a category for which there are any
number of contestant’s shots specified in this Contract are eligible for a Hole-In-One prize.
5. SHOTS - A shot is defined as a ”stroke“ by the USGA Rules of Golf. Only one shot per eligible contestant, as defined above, per
target hole is permitted. No practice shots, mulligans or substituted shots for other contestants are permitted. Each category of
authorized number of shots is permitted only during the stipulated round(s) of the named event on the date(s) agreed upon.
6. PRIZE PAYMENT - NHIO shall not be obligated to pay for a prize if the contestant’s category status (i.e., Amateur, Club or Tour
Professional), as those are defined herein, has no shots specified in the Contract. (Example: If a Club Pro makes a hole-in-one but
shots were specified only for Amateurs and/or Tour Pros, NHIO is not obligated to pay a prize.)
7. PRIZE RESTORATION - The prize value up to $99,999 is restored automatically to its original amount for each and every qualified
hole-in-one. If the prize value stated on Page 1 of this contract exceeds $99,999 there will be a maximum of 1 winner
allowed.
8. TARGET HOLE - Client may designate as many target holes as desired, and event fee will be set accordingly. Only one
predesignated cup hole may be used for each designated target hole green.
C. AFTER EVENT
1. CLAIM NOTIFICATION - Client/Prize Sponsor must notify (by telephone or e-mail) NHIO of a claim no later than the first business
day after the event. For email notification of a hole in one, please email, [email protected] no later than the first business day after
the event.
2. PROOF OF CLAIM - As proof of Hole-In-One claim Client will furnish NHIO the following documentation no later than 90 days after
claim notification: (a) Attested statements by the target hole witnesses (see B.1. above), the successful Ace-Maker® and resident
pro (these forms will be furnished by NHIO). (b) Original Shootout Pairing Sheet of the Shootout director. If required, Shootout
director shall also supply address and phone number of contestants, whether or not they are amateurs or professionals, and any
other information deemed relevant to the claim by NHIO. (c) Continuous unedited videotape, when required by B.1 above.
3. INVESTIGATION - Client shall cooperate fully with any claim investigation deemed warranted by NHIO in its sole discretion including
but not limited to polygraph examinations. If requested by NHIO, the Client and/or Prize Sponsor shall take a polygraph exam and
shall produce for examination the witnesses (see B.1. above), the Ace-Maker®, other eligible contestants and/or the resident pro.
All polygraph examinations are to be completed by a licensed (where applicable) American Polygraph Association member
polygrapher selected by NHIO. Each person whose examination is requested by NHIO must pass (i.e. no attempted deception) his
polygraph examination as judged by the examiner administering the test as a condition to NHIO's obligation to pay a claim.
4. DISPUTED CLAIMS - The Client agrees that any dispute hereunder will be governed by the laws of the State of Texas and
submitted to binding arbitration in compliance with rules established by the American Arbitration Association. If there is litigation with
NHIO and/or Great American Alliance Insurance Co., pertaining to the claim it shall be resolved solely and exclusively in an
appropriate court in Dallas County, Texas. By causing NHIO to issue this Contract the Client agrees that it is subject to the personal
jurisdiction of that court and to that venue as the exclusive one for all litigation arising out of issuance of this Contract. The Client
agrees that the results of polygraphic examinations taken in connection with NHIO's investigation (see C.3. above) shall be
admissible in evidence to the extent not prohibited by applicable law and agrees to take any actions necessary to secure the
admission of such evidence in any litigation or arbitration proceeding. The prevailing party in that litigation is entitled to recover a
reasonable attorney’s fee to be based solely on the amount of time expended by counsel.
5. HOLD HARMLESS - Client agrees to defend, protect, indemnify and hold harmless NHIO from any and all claims or causes of
actions brought by the Ace-Maker® arising out of the issuance of this Contract including the fees of counsel selected by NHIO to
defend such action.
D. VARIABLE EVENT CONDITIONS
1. CHANGES - Any changes in specific event data (except prize value) such as number of shots, hole yardage, hole number, dates,
etc., must be reported to NHIO PRIOR TO THE START OF THE EVENT. Such changes may be reported by telephone (800 527-
6944), Monday through Friday, 8 AM – 5 PM Central Time. Otherwise, such changes must be reported in writing via fax (972 808-
9012), or email to [email protected] and received by NHIO prior to the start of the event. CHANGES TO PRIZE VALUE MUST BE
APPROVED IN WRITING BY NHIO PRIOR TO THE START OF THE EVENT. Failure to report all such changes may result in a
prize denial or pro-ration. Any premium adjustments will be billed to the Client after the event.
2. SHOOTOUT EVENT - A golf event where contestants are qualified by skill level in a designated target hole competition or some
other selection method disclosed to NHIO prior to binding coverage. A list of eligible contestants will be prepared. Each contestant
may have only one shot unless otherwise approved in writing by NHIO. With all contestants and required witnesses present each
contestant shall take their shot in orderly succession until each has completed their shot.
a. Shots - Each contestant category of authorized shots specified on the Contract is NOT subject to any
variances. Such shots in the Shootout Event are not part of a round of golf.
3. EVENT CANCELLATIONS - If an event is cancelled without any shots being taken, it may be rescheduled at no additional charge. If
such an event is not rescheduled, the full Contract fee will be refunded subject to a $50 cancellation fee if signs were shipped
prior to NHIO's receipt of a cancellation notice. Contract fees for partially completed events will be refunded or credited for unused
shots on a pro rata basis subject to a minimum $100 cancellation fee. Refunds or credits must be requested in writing and received
by NHIO within 30 days of the date the event was scheduled to occur.
